Polk County Clerk Office

The Polk County Clerk's office is on the second floor of the Polk County Judicial Center in Livingston. The office handles marriage licenses, vital records, land filings, and other official county documents. Marriage license applications are accepted Monday through Friday from 8:00 AM to 4:30 PM. Do not arrive expecting to apply for a license after 4:30 PM, as the office stops accepting applications at that time.

The District Clerk is also located in the same Judicial Center building, one floor down at Suite 216. If you need court records in addition to marriage licenses, both offices are in the same building at 101 West Mill Street in Livingston.

Polk County has an online marriage license search through the county website. You can also use the online application form to fill out information in advance. Applying for a Polk County Marriage License

The Twogether in Texas program offers a free premarital education course that qualifies you for the reduced fee. Under Texas Family Code Chapter 2, completing the state-approved course also waives the 72-hour waiting period. The certificate must be presented at the time of application.

Texas requires a 72-hour wait after license issuance before the ceremony. Active-duty military members can waive this with their military ID. A judge with family law jurisdiction can also grant a written waiver for good cause. Absent from these exceptions, the 72 hours is mandatory.

The informal marriage license in Polk County costs $46.00. This registers a common law marriage under Texas Family Code Section 2.401. Both parties sign a declaration at the clerk's office, and the clerk records it.
