Applying for a Marriage License
Both applicants must appear together at the Trinity County Clerk's office in Groveton. Each person needs a valid government-issued photo ID such as a driver's license, state ID, or passport. You will also need your Social Security number. Both parties must be at least 18 years old. Under Texas Family Code Chapter 2, the license is valid anywhere in Texas, not just in Trinity County.
The standard fee is $81. If you complete the Twogether in Texas premarital education course, the fee is reduced and the 72-hour waiting period is waived. Without the certificate, you must wait 72 hours after the license is issued before holding the ceremony, as required under Section 2.204 of the Texas Family Code. The license is valid for 90 days from the date of issue. If the ceremony does not happen within that window, the license expires.
If either party was divorced, the divorce must have been final for at least 30 days before a new license can be issued in Texas. A court can waive this requirement in some situations.
Certified Copies of Marriage Records
Certified copies of Trinity County marriage licenses are only available from the Trinity County Clerk. The Texas DSHS Vital Statistics Section keeps a statewide index from 1966 forward, but only issues $20 verification letters. For a certified copy with the county seal, the Trinity County Clerk is your source.
Contact the clerk's office by phone or in person to request a copy. For mail requests, write to the Trinity County Clerk in Groveton with the full names of both parties, the approximate date of marriage, and payment for the fee. The clerk will search the records and respond with either the certified copy or a note that the record was not found. Allow extra time for mail requests.
Note: Texas does not issue marriage certificates. The marriage license is the legal document. A certified copy of the license is what you need for name changes and official purposes.
What Trinity County Marriage Records Show
Trinity County marriage license applications follow the state format under Texas Health and Safety Code Chapter 194. Each record includes both parties' legal names, dates of birth, addresses, and Social Security numbers. It shows the issue date, ceremony date, ceremony location, and the officiant's name. Prior marriages and their endings are also noted.
Under state law, the county clerk must send a copy to the Texas DSHS Vital Statistics unit within 90 days of the application. Both records are public. Anyone with the parties' names and approximate marriage date can request a copy from either the county or the state.
Informal Marriage Registration
Texas recognizes informal marriage under Texas Family Code Section 2.401. Couples in Trinity County can register by signing a Declaration of Informal Marriage at the clerk's office. This creates a public record with the same legal standing as a formal marriage license. The fee is typically around $46.
Without a declaration, you can still establish an informal marriage if you can prove an agreement to be married, that you lived together in Texas as spouses, and that you presented yourselves as married to others. The declaration is the simpler approach and avoids any later disputes about whether the marriage was legally established.
