How to Get a Marriage License

Texas law requires both parties to appear in person at the County Clerk's office to apply for a marriage license. No proxies are allowed. Both people must have a valid government-issued photo ID such as a driver's license, passport, or military ID. Each person must also provide their Social Security number. Expired IDs are not accepted.

The fee for a marriage license in San Jacinto County follows the standard Texas rate of $81.00 for residents. If neither party is a Texas resident, the fee is $181.00. Couples who complete the free Twogether in Texas premarital education program pay roughly $21.00 when they bring their certificate to the clerk's office. The program is free and offered at locations throughout the state.

After the license is issued, Texas Family Code Section 2.204 requires a 72-hour waiting period before the ceremony. The Twogether certificate waives this. A judge can also waive the waiting period in certain circumstances. Under Section 2.201, the license remains valid for 90 days. Use it within that window or you will need to apply again.

Both people applying must be at least 18 years old. If either party was recently divorced, the divorce must have been final for at least 30 days before a new marriage license can be issued, unless a court waived that requirement.

Getting Certified Copies

Certified copies of marriage licenses from San Jacinto County must be ordered from the County Clerk. The Texas Department of State Health Services only issues verification letters. It does not provide certified copies of marriage licenses. This is true for all Texas counties. If you need a certified copy for a name change, estate matter, or legal proceeding, contact the San Jacinto County Clerk.

Requests can be made in person or by mail. In-person requests are usually processed same day. For mail requests, include the full names of both spouses, the date or approximate year of the marriage, a check or money order for the fee, and a return address. Contact the clerk's office at the number on their website to confirm the current fee for certified copies before you send payment.

VitalChek may also process online orders for some Texas counties. Check whether San Jacinto County is listed in their system. The DSHS vital statistics office can confirm a marriage is in the state index and direct you to the right county if you are not sure where the license was issued.

Informal Marriage in San Jacinto County

Texas recognizes informal marriage, often called common law marriage. Under Texas Family Code Section 2.401, couples can formalize an informal marriage by filing a Declaration of Informal Marriage at the County Clerk's office. Both parties must appear in person to complete this process.

An informal marriage requires three things: mutual agreement to be married, living together in Texas as spouses, and holding out to others that you are married. No minimum time period applies. An informal marriage carries full legal weight once established. You need a formal divorce to end it. Filing the declaration with the clerk creates an official public record of the relationship, which can matter for insurance, estate planning, and other legal purposes.

Texas Marriage Law Overview

All Texas marriage licenses are governed by Texas Family Code Chapter 2. This covers who can marry, what ID is required, how long a license is valid, and when the waiting period applies. County clerks across Texas follow the same state rules, so the process in San Jacinto County is consistent with what you would find in any other Texas county.

The Texas Health and Safety Code Chapter 194 explains how county clerks report marriage data to the state and how the statewide index is built and maintained. This law also governs what information the state can release and confirms that the state cannot issue certified copies.

Marriage license records become public once filed. Most records are accessible by any member of the public. Contact the San Jacinto County Clerk to ask about fees, search procedures, and what information you need to provide when requesting a record search.
