Getting a Marriage License in Jasper County

To get a marriage license in Jasper County, both applicants must go to the clerk's office together. You each need a valid government-issued photo ID. Driver's licenses and passports are both acceptable. You will need your Social Security number. The clerk will walk you through the application form. The whole process is straightforward and usually takes less than an hour.

Texas law requires a 72-hour waiting period before you can have the ceremony. This is in Texas Family Code Section 2.204. There is one way around it. Complete the free Twogether in Texas premarital education course and present your certificate when you apply. This waives the 72-hour wait and takes $60 off the license fee. The standard fee is around $81. With the Twogether certificate, it drops to about $21. The certificate must be from within the past year. Your license is valid for 90 days after issue, so set your ceremony date before you apply.

Note: Both parties must be 18 or older. Texas does not allow minors to marry without a court order.

Certified copies of Jasper County marriage licenses must be requested from the Jasper County Clerk. The Texas Department of State Health Services keeps a statewide index from 1966 onward and can provide $20 verification letters, but it does not issue certified copies. Only the county clerk in Jasper can do that for licenses issued in this county.

For in-person requests, visit the clerk's office during business hours. For mail requests, send to P.O. Box 2070, Jasper, TX 75951. Include the full names of both parties, the approximate date of marriage, and payment for the copy fee. Call (409) 383-0271 to confirm the current fee before sending a request by mail. DSHS statewide records can be reached at (888) 963-7111.

Certified copies carry the clerk's official seal. They are accepted for name changes, legal filings, insurance updates, and other official uses. Under Texas Health and Safety Code Chapter 194, the county sends a copy of each application to the state within 90 days.

Informal Marriage in Jasper County

Texas recognizes informal marriage under Texas Family Code Section 2.401. Couples in Jasper County can formalize an informal marriage by signing a Declaration of Informal Marriage at the county clerk's office. This creates a public record. Without a declaration, informal marriage can still be established by proving three elements: an agreement to marry, cohabitation in Texas as spouses, and public representation of the marriage to others.

Informal marriages carry the same legal weight as formal ones. Community property laws apply. A formal divorce is required to end the marriage. Ask the Jasper County Clerk for the Declaration of Informal Marriage form if you want to create a documented record.
