How to Get a Marriage License in Hardin County
Both parties must appear in person at the clerk's office to apply for a marriage license. Each person needs a valid government-issued photo ID and their Social Security number. No blood test is required. Both applicants must be 18 or older. Under Texas Family Code Chapter 2, a license issued in Hardin County is valid for use anywhere in the state.
The standard license fee is $81. Couples who complete the Twogether in Texas premarital education course and bring the completion certificate on the day they apply pay only $21. The certificate also waives the 72-hour waiting period required by Section 2.204 of the Family Code. Without the certificate, you must wait 72 hours from the time the license is issued before the ceremony can take place.
The license remains valid for 90 days from the date of issue. If no ceremony takes place within that window, the license expires. You cannot extend or renew it. You would need to apply again, pay again, and go through the same process.
Note: If neither applicant can prove Texas residency, an out-of-state applicant fee may apply. Call the clerk to confirm current fees before your visit.
Getting Copies of Hardin County Marriage Records
If you need a certified copy of a marriage license issued in Hardin County, the County Clerk is the only source. The Texas DSHS Vital Statistics Section maintains a statewide index of marriages from 1966 forward, but they only issue verification letters for $20, not certified copies. For any legal or official purpose, certified copies must come from the issuing county.
You can request a copy in person at the courthouse or by sending a written request by mail. Include the full names of both parties, the approximate year of the marriage, and your contact information. Include payment for the applicable fee. The clerk will search the records and send the copy once it is ready. Certified copies include the clerk's seal and signature and are accepted for name changes, insurance claims, and government filings.
What Hardin County Marriage Records Include
Texas marriage license applications follow a state-set format. The application records both parties' full legal names, birth dates, addresses, and Social Security numbers. It shows the date and county the license was issued, the date of the ceremony, where it took place, and who performed it. Any prior marriages and how they ended are also part of the application.
Under Texas Health and Safety Code Chapter 194, the county clerk must send a copy to the state vital statistics unit within 90 days. The state indexes these records under both parties' names. The county holds the original license. Marriage records in Hardin County are public records and available to anyone who requests them with sufficient identifying information.
Informal Marriage in Hardin County
Texas law recognizes informal marriage under Texas Family Code Section 2.401. Couples can register an informal marriage by signing a Declaration of Informal Marriage at the Hardin County Clerk's office. This creates an official record of the relationship. Without a declaration, a couple can still prove an informal marriage by showing they agreed to be married, lived together in Texas as spouses, and held themselves out to others as married.
Once a marriage, formal or informal, is established in Texas, it requires a formal divorce to end it. The Hardin County Clerk can provide information on filing a Declaration of Informal Marriage for couples who want their relationship on record.
