Getting a Marriage License in Wharton County

Both applicants must appear together at the Wharton County Clerk's office. Each person needs a valid government-issued photo ID and their Social Security number. Both must be at least 18 years old. Under Texas Family Code Chapter 2, the license is valid anywhere in Texas. You do not have to get married in Wharton County.

The standard fee is $81. Completing the Twogether in Texas premarital education course reduces the fee and waives the 72-hour waiting period. Without the certificate, you must wait 72 hours after the license is issued before holding the ceremony under Section 2.204 of the Texas Family Code. The license is good for 90 days from the date of issue. If either party was previously divorced, the divorce must have been final for at least 30 days.

The Wharton County Clerk's office offers several online services through the county website at co.wharton.tx.us. You can request vital documents online including birth, death, and marriage records. Property records are also searchable online. Civil, criminal, and probate records and marriage license information are available through the portal. Foreclosure notices are also posted online.

The online services make Wharton County one of the more accessible rural counties for remote records requests. This is especially helpful if you live outside the county or cannot visit the Wharton office during business hours. Check the county website for instructions on how to submit an online vital document request and what information to include.

Note: Even with online request options, certified copies still need to be issued directly by the clerk's office. Processing times for mail and online requests may be longer than in-person visits.
