Getting a Marriage License

All Texas marriage licenses follow the rules set in Family Code Chapter 2. Both people must be at least 18 years old and must appear in person at the clerk's office together. No blood test is needed. Texas has no residency requirement, so out-of-state couples can get a license in Fannin County.

After the license is issued, a 72-hour waiting period applies. You cannot hold your ceremony until that time has passed. To skip this wait and reduce your fee, complete the Twogether in Texas premarital education course and present the certificate at the time of application. The certificate is valid for one year from the completion date. If you show up without it, you pay the full fee and wait the full 72 hours.

The license stays valid for 90 days from issue. If you do not marry within that window, it expires. There is no way to extend it. After the ceremony, the officiant returns the signed license to the Fannin County Clerk within 30 days. The clerk records it and sends a copy to the state vital statistics unit.
