Cooke County offers online search tools for several types of records. Criminal and civil court records can be searched through the county's online system. Free real property and land records search is also available. These tools let you look up indexes and, in some cases, view document images without visiting the courthouse in person.

The clerk also offers online payment for criminal court costs, fines, and restitution. If you need to make a payment online, call the clerk's office first to get your exact balance. Overpayment can cause delays, and the office does not accept personal checks for in-person transactions.

Note: The online records search is for index and public records. Certified copies of marriage licenses cannot be obtained through the online portal and must be requested from the clerk's office directly.

Getting a Marriage License in Cooke County

Both applicants must appear together at the Cooke County Clerk's office in Gainesville. Each person must bring a valid photo ID, such as a driver's license, state ID card, or passport. You must also verbally provide your Social Security number to the clerk. No blood test is needed. Both parties must be at least 18 under Texas Family Code Chapter 2.

Texas law requires a 72-hour waiting period between when the license is issued and when the ceremony can be performed. This is set out in Texas Family Code Section 2.204. The wait is waived if you complete the free Twogether in Texas premarital education course and bring the certificate to the clerk's office when you apply. The same certificate reduces the license fee significantly, typically from around $76-82 down to $21.

The license is valid for 90 days from the date of issue. It can be used for a ceremony anywhere in the state of Texas, not just within Cooke County.

Certified copies of a Cooke County marriage license come from the Cooke County Clerk. The Texas Department of State Health Services maintains a statewide marriage index going back to 1966 and can issue verification letters for $20, but only the county that issued the license can provide a certified copy.

To get a copy, visit the clerk's office in person at 101 South Dixon, Gainesville, or send a written request by mail. Include the full names of both parties, the approximate year of the marriage, and payment for the applicable fee. Certified copies carry the clerk's official seal and are accepted for name changes, immigration filings, and other legal purposes. Plain copies are not available for vital records in most Texas counties.

What the Records Show

Cooke County marriage license records include both parties' full legal names, dates of birth, addresses, and Social Security numbers. The record also shows the date the license was issued, the date and place of the ceremony, the officiant's name, and information about prior marriages. Under Texas Health and Safety Code Chapter 194, the county clerk must send a copy of each license to the state vital statistics unit within 90 days.

Marriage records are public documents in Texas. Anyone may request a copy with enough identifying information to locate the specific record.

Informal Marriage in Cooke County

Texas recognizes informal marriage under Texas Family Code Section 2.401. Couples in Cooke County can register an informal marriage by completing a Declaration of Informal Marriage at the County Clerk's office. Once filed, the declaration is a public record with the same legal effect as a traditional marriage license.

A couple that did not file a declaration can still prove an informal marriage by showing they agreed to be married, lived together in Texas as a married couple, and represented to others that they were married. For a clean paper trail, the declaration filed with the clerk is the better option.
