Getting a Marriage License in Delta County
Texas law sets the same basic requirements for all counties. Both applicants must appear together at the County Clerk's office in Cooper. You need a valid photo ID. A driver's license, passport, certified birth certificate issued within the last 10 years, or military ID all work. Bring your Social Security number. The application is completed in the office with a staff member.
After the license is issued, you must wait 72 hours before the ceremony can take place. This is required by Texas Family Code Section 2.204. The license is good for 90 days from the date issued under Section 2.201. If you do not get married within that period, you will need to start over and pay again. After the ceremony, the officiant signs the license and it must be returned to the county clerk within 30 days.
Completing the Twogether in Texas premarital education course waives the 72-hour wait and reduces the license fee by $60. The course is free and offered by providers across Texas. Bring the certificate to the clerk when you apply. It is valid for one year from the date of completion.
Delta County Historical Marriage Records
Delta County was created on July 29, 1870 from Hopkins and Lamar Counties. Marriage records start in 1871, just after the county was formed. Land records go even further back to 1836. Court records start from 1872, probate records from 1876. Birth records start from 1903, and death records from approximately 1916.
One important historical note: on March 9, 1899, the Delta County Courthouse in Cooper was destroyed by fire. Most county records were stored in a fireproof vault and survived the fire. However, records in the district clerk's office at the time, mostly current active cases, were lost. Marriage records from the county clerk were largely saved because of the vault. This means the collection is relatively intact for a county that old.
For genealogical research on Delta County marriages, FamilySearch has indexed some early Texas marriage records. The Texas State Library and Archives Commission also holds some historical collections. The Texas DSHS maintains a statewide index from 1966 forward.
Certified Copies of Delta County Marriage Records
Only the Delta County Clerk can issue certified copies of marriage records from this county. The state does not provide certified copies. Under Texas Health and Safety Code Chapter 194, DSHS can verify a marriage took place but cannot issue a certified copy. You need the certified copy from the county for legal purposes like name changes or government filings.
Request a certified copy in person at the courthouse, or contact the clerk by phone at (903) 395-4400 ext. 222 to ask about mail requests. For mail requests, include the full names of both parties, the approximate date of marriage, a copy of your photo ID, and the fee. Send to P.O. Box 455, Cooper, TX 75432. Call ahead to confirm the current fee before sending payment.
Note: Texas does not issue marriage certificates. The document issued by the county is a marriage license. The certified copy of that license is the official legal document most agencies require.
What Delta County Marriage Records Include
A Delta County marriage license shows the full legal names of both parties, their dates of birth, addresses at the time of application, and identification numbers. It shows the date the license was issued, the license number, and the county. After the ceremony, the signed return includes the date of marriage, the officiant's name and certification, and witness signatures. The completed document is filed with the clerk and becomes the permanent record.
Texas also allows informal marriage under Texas Family Code Section 2.401. A couple that meets all three legal requirements, agreement to marry, living together in Texas as spouses, and holding out to others as married, can file a Declaration of Informal Marriage with the Delta County Clerk. This creates a public record of the marriage. Most marriage records at the county level are public documents.
