Marriage License Requirements

To get a marriage license in Shelby County, both parties must show up in person at the clerk's office. Texas does not allow one person to apply on behalf of another. Each applicant must present a valid government-issued photo ID and provide their Social Security number. Expired IDs are not acceptable.

The fee is $81.00 for Texas residents under Texas Family Code Chapter 2. Out-of-state residents pay $181.00. The Twogether in Texas premarital education certificate reduces the fee to about $21.00. This free program is available throughout the state, and the certificate also waives the 72-hour waiting period.

Under Section 2.204, Texas requires couples to wait 72 hours after the license is issued before they can marry. This is waived with a Twogether certificate or by a judge's order. The license is good for 90 days under Section 2.201. If it expires, you need to apply again from scratch.

Both parties must be at least 18 years old. Previously divorced applicants must have a final divorce decree that was entered at least 30 days before the new marriage application, unless a court waiver was granted.

Certified Copies and Searches

Certified copies of Shelby County marriage licenses must be obtained from the County Clerk in Center. The Texas Department of State Health Services maintains a statewide index and can issue a $20.00 verification letter, but that is not the same as a certified copy. For legal purposes such as name changes or estate matters, you need the certified copy from the county.

You can request copies in person or by mail. For mail requests, provide both spouses' full names, the year of the marriage, payment for the fee, and your return address. Call the clerk's office beforehand to confirm current fees and payment methods. VitalChek may offer online ordering for Shelby County records; check their site to see if it is listed.

The DSHS vital statistics office can help if you are uncertain which county holds the record you need. Call (888) 963-7111 and provide names and an approximate date. DSHS can search the state index and direct you to the correct county clerk.

Shelby County marriage records - CDC where to write Texas

The CDC guide confirms that certified copies in Texas always come from the county clerk, not from a state office.

Informal Marriage in Shelby County

Texas law allows couples to register an informal marriage at the County Clerk's office. Under Texas Family Code Section 2.401, both parties file a Declaration of Informal Marriage. Both must appear in person to sign it.

Three things must be true: the couple agreed to be married, they lived together in Texas as spouses, and they held themselves out to others as married. No minimum time is required. An informal marriage has the full legal standing of a formal marriage. A divorce is needed to end it. Filing the declaration at the clerk's office creates a public record that can be used for legal and financial purposes.

Legal Framework and State Resources

Texas marriage law is contained in Texas Family Code Chapter 2. This covers everything from the application to the 90-day validity window. The same rules apply in Shelby County as in every other Texas county.

The Texas Health and Safety Code Chapter 194 outlines the county clerk's obligation to report marriage data to the state and how the statewide index is built. It also confirms that the state cannot issue certified copies. The Texas State Library and Archives Commission holds historical records going back to the Republic of Texas period, and FamilySearch has digitized many county records for free online access.
