How to Get a Marriage License

Both applicants must go together to the Titus County Clerk's office. Each needs a valid photo ID and a Social Security number. Under Texas Family Code Chapter 2, a license issued in Titus County is valid for use anywhere in Texas. You do not have to get married in the county where the license was issued.

The standard fee is $81. Couples who complete the Twogether in Texas premarital education course pay a reduced fee and do not have to wait the standard 72-hour period. Without the certificate, you must wait 72 hours after getting the license before the ceremony. This is required under Section 2.204 of the Texas Family Code. Active military members may also qualify for a waiver. The license is good for 90 days from issue. If you do not use it within that time, it expires.

If either party was previously married and divorced, Texas requires the divorce to have been final for at least 30 days. A court order can waive this in some circumstances. Bring documentation of any prior divorce when you apply.

Certified copies of marriage licenses issued in Titus County must come from the Titus County Clerk. The Texas DSHS Vital Statistics Section keeps a statewide index from 1966 to present, but can only issue verification letters at $20 each. That is not the same as a certified copy. Only the issuing county can provide a certified copy with the official seal.

To request a copy, contact the clerk's office with the full names of both parties and the approximate date of marriage. You can request in person during regular hours or by mail. Mail requests should go to the county clerk's office at the courthouse address. Include payment in the form accepted by the office. The clerk will search the index and send the copy if a matching record is found.

Note: Texas issues marriage licenses, not marriage certificates. A certified copy of the marriage license is the legally accepted document for name changes, insurance updates, and similar official purposes.
