Getting a Marriage License in Palo Pinto County
To get a marriage license in Palo Pinto County, both people must appear in person at the County Clerk's office. You cannot send just one person. Both parties must bring valid photo ID and their Social Security numbers. The standard fee is $81.00 for a marriage license without a premarital education certificate.
Texas law requires a 72-hour waiting period after the license is issued before you can hold a ceremony. This rule comes from Texas Family Code Chapter 2. The 72-hour wait can be waived if you complete an approved premarital education course through the Twogether in Texas program. That course also lowers your license fee from $81.00 down to $21.00, which saves you $60. Members of the armed forces on active duty can also have the wait waived.
Once issued, the license is valid for 90 days. If you do not use it within 90 days, it expires and you have to start over. The ceremony must take place in Texas. After the ceremony, the officiant signs and returns the completed license to the County Clerk for recording.
You can also register an informal marriage (sometimes called a common law marriage) at the County Clerk's office. The fee for that is $46.00. Under Texas Family Code Section 2.401, both parties sign a declaration form and the clerk records it as an official marriage record.
