Getting a Marriage License in Hidalgo County

Both people getting married must go to the Hidalgo County Clerk's office together. Each person needs a valid photo ID such as a driver's license or passport. You must provide your Social Security number. No blood test is required. Both parties must be 18 or older. Under Texas Family Code Chapter 2, a license issued in Hidalgo County is valid anywhere in Texas.

The standard fee is $81. If you and your partner complete the Twogether in Texas premarital education course before applying, the fee is reduced to $21. You need to bring the course completion certificate on the day you apply. The certificate also waives the 72-hour waiting period. Without the certificate, Texas law requires a 72-hour wait after the license is issued before the ceremony can take place. Plan around this if you have a tight schedule.

The license is valid for 90 days. If the ceremony does not occur in that time, the license expires and you must apply again. There is no way to extend it once it's issued.

Certified copies of Hidalgo County marriage licenses can only come from the Hidalgo County Clerk. The Texas DSHS Vital Statistics Section holds a statewide marriage index from 1966 and can provide a $20 verification letter, but DSHS cannot issue certified copies. Only the issuing county can do that.

To request a copy in person, go to the clerk's office in Edinburg with the full names of both parties and the approximate date of the license or ceremony. Mail requests go to the P.O. Box address and should include the same identifying information along with payment. The clerk can tell you the current fee for certified copies when you call.

Hidalgo County has a long record history starting in 1852. Birth and death records start from 1903, and land records also go back to 1852. For older marriage records not yet indexed online, a direct request to the clerk or an in-person search may be necessary.

Note: Texas does not issue marriage certificates. The official document is the marriage license, and certified copies of that license serve as legal proof of marriage.

What Hidalgo County Marriage Records Contain

A marriage license application in Hidalgo County follows the state-mandated format. It includes both parties' full legal names, dates of birth, addresses, and Social Security numbers. It also records the license issue date, the ceremony date, the location of the ceremony, the name of the officiant, and details about any prior marriages and how they ended.

Under Texas Family Code Chapter 2, the county clerk sends a copy to the Texas Vital Statistics Section within 90 days of the application. The state adds both names to its statewide index. The original stays in Hidalgo County. These records are public, and anyone with enough identifying information can request a copy.

Informal Marriage in Hidalgo County

Texas recognizes informal marriage under Texas Family Code Section 2.401. Couples in Hidalgo County can register an informal marriage at the clerk's office by signing a Declaration of Informal Marriage. Once filed, this declaration is a public record with the same legal standing as a formal marriage license.

If a couple does not file a declaration, they may still establish an informal marriage by proving three elements: agreement to be married, living together in Texas as a married couple, and representing themselves to others as married. Given Hidalgo County's large and active court system, having a documented record can matter a great deal. Registering is the most straightforward way to make the relationship part of the official public record.
