Marriage License Requirements

Texas law requires both applicants to appear in person at the county clerk's office when applying for a marriage license. Under Texas Family Code Chapter 2, each person must present a valid government-issued photo ID and provide their Social Security number. A driver's license, passport, state ID, or military ID all satisfy the photo ID requirement.

Both parties must be at least 18. Texas no longer allows minors to marry under any circumstances unless they have a separate court order for general emancipation under the Family Code. The 2017 law change closed the prior parental consent pathway that existed for marriage.

If either applicant has been previously married, the clerk will ask for the date the prior marriage ended. A 30-day waiting period applies after a divorce before remarriage is allowed under Family Code Section 2.009. If you were widowed, bring documentation showing the date of the spouse's death if it was recent.

Note: The City of McAllen does not issue marriage licenses. The city secretary handles municipal matters, but marriage licensing is a county function.

License Fees and the 72-Hour Wait

Hidalgo County charges $81 for a standard marriage license. If both parties are Texas residents and complete the Twogether in Texas premarital education program, you can present the certificate at time of application to receive a $60 discount. That brings the fee down to $21. The Twogether program is free to complete and helps couples build communication and relationship skills.

After the clerk issues your license, you must wait 72 hours before the ceremony under Texas Family Code Section 2.204. The Twogether certificate also waives this waiting period. If you complete the program and present your certificate, you can apply and get married the same day.

The license remains valid for 90 days from the issue date under Family Code Section 2.201. If you do not use it within that window, it expires and you start over. Plan your ceremony date in advance to make sure you use the license in time.

Certified copies of marriage records cost extra. Call the Hidalgo County Clerk at (956) 318-2100 for current copy fees. The state DSHS office cannot provide certified copies of marriage licenses. That service is only available from the county clerk.

Informal Marriage in Hidalgo County

Texas allows couples to formalize an informal marriage by signing a Declaration of Informal Marriage at the county clerk's office. Under Texas Family Code Section 2.401, a common law marriage exists when parties agree to be married, live together as spouses in Texas, and represent to others that they are married. No minimum cohabitation time is required.

McAllen residents can file the declaration at the Hidalgo County Clerk's office. It becomes part of the county's official marriage records. An informal marriage carries the same legal weight as a ceremonial one, including community property rights and the requirement of formal divorce to dissolve the marriage.
