Gaines County Overview
Gaines County Clerk Office
The Gaines County Clerk is located at 101 South Main Street in Seminole. The office issues marriage licenses, handles certified copy requests, and maintains the county's official marriage index. E-filing is available, which helps streamline certain document submissions. The clerk's office is the sole source for certified copies of Gaines County marriage licenses.
The Texas Department of State Health Services can issue a verification letter for $20 for marriages in the statewide index from 1966 forward. But verification letters are not certified copies. Under Texas Health and Safety Code Section 194.004, the state cannot issue certified copies of marriage records. Only the county clerk where the license was originally issued can do that.

Marriage License Requirements
Both applicants must appear in person at the Gaines County Clerk's office in Seminole. Valid photo ID is required for each person. A driver's license, passport, or military ID all qualify. Both parties must provide their Social Security numbers. Minimum age is 18. Under Texas Family Code Chapter 2, any license issued in Gaines County is valid for ceremonies held anywhere in the state.
After the license is issued, a 72-hour waiting period applies before the ceremony can take place. Couples who complete the Twogether in Texas premarital education course can get a $60 discount on the fee and waive that 72-hour wait. The course certificate is valid for one year from completion and must be presented when you apply. The license expires 90 days after issuance if not used.
Note: There is no Texas marriage certificate. The license is the legal record. Certified copies of that document come from the county clerk.
Getting Certified Copies
To request a certified copy of a Gaines County marriage record, contact the clerk's office in Seminole. You can request in person during office hours or by mail. For mail requests, provide both parties' full legal names, the approximate marriage date, and payment. Certified copies include the clerk's seal and are legally recognized for name changes, government filings, and insurance purposes.
For marriages after 1966, the Texas DSHS Vital Statistics Section keeps a statewide index and can confirm a marriage exists. You can also request expedited service through VitalChek, which processes orders on behalf of the county. The county office directly processes walk-in and mail requests.
Historical Records and Research
For genealogical research, FamilySearch and the Texas State Library and Archives Commission are good places to start. The state library holds records from the Republic of Texas period and early statehood, and FamilySearch has digitized many county-level records that are searchable for free.
For marriages from 1966 to the present, the DSHS statewide index is searchable. Earlier records from Gaines County are held by the county clerk or may be available through genealogical databases. The Library of Congress guide at guides.loc.gov is a helpful overview of where different types of Texas vital records are held.
Informal Marriage Registration
Texas allows couples to register an informal marriage by signing a Declaration of Informal Marriage at the county clerk's office. In Gaines County, this is handled at the Seminole courthouse. Under Texas Family Code Section 2.401, informal marriage has the same legal standing as a formal license and requires a formal divorce to dissolve. Couples who do not file a declaration can still establish informal marriage by proving the three required elements: agreement to marry, living together as spouses in Texas, and holding out to others as married.
