Marriage License Requirements in Yoakum County
Both applicants must be present at the clerk's office in Plains. Each person must bring a valid photo ID. Accepted forms include a driver's license, state ID, passport, or certified birth certificate. Your Social Security number is also required. Both parties must be at least 18 years old. If either applicant is under 18, a court-issued emancipation order is required before the clerk can process the application.
The standard marriage license fee is $81. If you complete the Twogether in Texas premarital course, the fee drops to $22. You must present the certificate when you apply. The program also waives the 72-hour waiting period that normally applies under Texas Family Code Section 2.204. Without the certificate, you must wait 72 hours after getting the license before the ceremony can take place.
Active-duty military members are exempt from the waiting period. A judge can also grant a waiver for good cause. The license is valid for 90 days from the date of issue. It expires at the end of that period and cannot be extended. If either party was previously divorced, the divorce must be final for at least 30 days before applying for a new license.
Note: At the time of application, county clerks are required by Texas law to provide marriage license applicants with HIV and AIDS information. This is a standard statewide requirement under DSHS guidelines.
Informal Marriage in Yoakum County
Texas recognizes informal marriage under Texas Family Code Section 2.401. Couples in Yoakum County can register a Declaration of Informal Marriage at the clerk's office in Plains. Both parties must appear in person, meet the same age requirement as a formal license, and pay a $46 filing fee. The declaration must also include the date when the couple began living together as a married couple.
The declaration creates an official public record. Couples who choose not to file can still claim informal marriage status in court, but only if they can prove all three required elements: agreement to be married, living together in Texas as spouses, and presenting themselves publicly as a married couple. Filing a declaration is far simpler if you ever need to prove the marriage for legal or financial reasons.
Certified Copies of Yoakum County Marriage Records
Certified copies of Yoakum County marriage licenses can only be issued by the Yoakum County Clerk. The Texas Department of State Health Services keeps a statewide marriage index from 1966 forward. DSHS can issue a verification letter for $20, but that is not a certified copy. Only the county where the license was filed can produce a certified copy with the official seal.
To request a copy, contact the clerk in Plains in person or by mail. Include both parties' full legal names and the date or approximate year of the marriage. Provide payment for the applicable fees when mailing your request. Certified copies are accepted by courts, government agencies, and financial institutions for purposes such as name changes and benefit claims.
What Yoakum County Marriage Licenses Show
Yoakum County marriage licenses follow the state-prescribed Texas format. The record shows both parties' full names, dates of birth, addresses, and Social Security numbers. It documents the date the license was issued, the ceremony date and location, and the name of the officiant. Prior marriages and how they ended are also recorded. Under Texas Health and Safety Code Chapter 194, the county clerk sends a copy to the Texas DSHS Vital Statistics Section within 90 days of the application date.
Both the county and state records are public documents. The state indexes under both parties' names. Anyone can request access with enough identifying information to locate the specific record they need.
