Marriage License Fees in Montgomery County

Montgomery County has a clearly defined fee structure. The standard fee without a premarital education certificate is $81.00, paid in cash. If you bring a completed Twogether in Texas certificate, the fee drops to $21.00. That's a $60 reduction just for completing the premarital education course.

The Twogether certificate must be presented at the time you apply for the license. You can't apply first and then bring the certificate later. If you plan to take advantage of the lower fee, complete the course before you head to the clerk's office.

Other fees to know:

  • Informal Marriage (Common-Law Declaration): $46.00 cash only
  • Certified Copy of Marriage License: $6.00 each
  • Plain (uncertified) Copy: $1.00 each

Montgomery County accepts cash only for marriage license fees at the time of application. Check current payment options when you visit or call ahead, as policies can change.

Requirements and Wait Period

Under Texas Family Code Chapter 2, both applicants must appear in person. You need to bring valid photo ID, your Social Security number, and payment. Both must be at least 18 years old, not currently married, and not closely related to each other. If you were recently divorced, the divorce must have been finalized at least 30 days before the new application.

After the license is issued, the 72-hour wait applies under Texas Family Code § 2.204 before you can hold the ceremony. This wait can be waived if you complete the Twogether in Texas course. Active military members facing deployment to hostile fire zones can also apply for a waiver. A judicial waiver is available in certain other circumstances through the court.

Your license is valid for 90 days from the issue date per Texas Family Code § 2.201. If the 90 days pass before the ceremony, the license expires and you'd need to start over. Plan the timing carefully. Getting your license one to two weeks before the event is common practice.

Note: Montgomery County requires a completed online marriage application before you visit. Go to the county website first to fill out the form, then bring it to the clerk's office along with your IDs.
