Getting a Marriage License in Zapata County
Both applicants must appear in person at the clerk's office. Each must bring a valid photo ID. Your Social Security number is required at the time of application. Both parties must be at least 18. The standard marriage license fee is $81. If you complete the Twogether in Texas premarital education program, the fee is reduced and the 72-hour waiting period is waived. Under Texas Family Code Chapter 2, the license is valid for use anywhere in Texas.
Without the Twogether certificate, Texas law requires a 72-hour wait between when the license is issued and when the ceremony can occur. Active-duty military members are exempt from this requirement. A judge can also waive the waiting period for good cause. If either party was divorced, the divorce must have been final for at least 30 days before the application. The license is valid for 90 days from the issue date. It expires at the end of that window and cannot be renewed.
Effective January 1, 2024, Zapata County no longer charges a $1.00 Courthouse Security Fee on marriage licenses. Senate Bill No. 1612 repealed that fee statewide. This applies to both formal and informal marriage license filings.
Certified Copies of Zapata County Marriage Records
Certified copies of Zapata County marriage licenses must come from the Zapata County Clerk. The Texas Department of State Health Services maintains a statewide index of marriages from 1966 forward and can issue a verification letter for $20, but it does not issue certified copies. Only the county clerk where the license was filed can produce a certified copy with the official seal.
To request a certified copy, contact the clerk's office in person or by mail at 200 E. 7th Avenue, Suite 115, Zapata, TX 78076. Include both parties' full names and the approximate date of the marriage. Recording fees are $25 for the first page and $4 for each additional page. Certified copies are legally valid for name changes, government filings, and similar purposes.
What Zapata County Marriage Records Show
Zapata County marriage licenses follow the standard Texas format. Each record includes both parties' full legal names, dates of birth, addresses, and Social Security numbers. The license documents when it was issued, when and where the ceremony took place, and who performed it. Any prior marriages and how they ended are part of the record as well. Under Texas Health and Safety Code Chapter 194, the county clerk forwards a copy to the state vital statistics unit within 90 days of the application date.
Both the county and state records are public. The state indexes under both parties' names. Anyone can request access with enough identifying information to find the specific record.
Informal Marriage in Zapata County
Texas recognizes informal marriage under Texas Family Code Section 2.401. Couples in Zapata County can register a Declaration of Informal Marriage at the clerk's office. Both parties must appear, be at least 18 years old, and pay the filing fee of $46. As of January 1, 2024, the courthouse security fee is no longer added to this filing. The declaration creates an official public record of the marriage with the same legal standing as a formal license.
Without a declaration, a couple can still establish informal marriage by proving they agreed to be married, lived together in Texas as a married couple, and represented to others that they were married. Filing a declaration is much simpler for legal purposes.
