Marriage License Requirements
Both applicants must appear at the clerk's office, though a proxy is allowed with the proper documentation. The absent applicant must have an affidavit properly executed and a copy of their ID must accompany the proxy form. Both parties must be at least 18 years old. Each applicant needs a valid photo ID (driver's license, military ID, or passport - must be current, no expired IDs) and a Social Security number (or a statement that none exists). Under Texas Family Code Chapter 2, the license is valid statewide.
Washington County fees: Texas residents pay $81.00. If neither party is a Texas resident, the fee is $181.00. Proof of residency is required if one party is a Texas resident. With a Twogether in Texas premarital education certificate, the fee drops to $21.00. The certificate must be presented when you apply and also waives the 72-hour waiting period.
Without the Twogether certificate, a 72-hour waiting period applies under Section 2.204 of the Texas Family Code. The waiting period can also be waived by a judge's order or if an applicant is on active military duty. The license is valid for 90 days. If either party was divorced, the divorce must have been final for 30 days prior, unless a court order waives this requirement.
