Getting a Marriage License in Nueces County

Both applicants must appear in person together at the Nueces County Clerk's office. Each person needs a valid, unexpired photo ID and a Social Security number. No blood test is required. Both must be at least 18. Under Texas Family Code Chapter 2, a license issued in Nueces County is valid for a ceremony anywhere in Texas.

The standard fee is $81. Texas Family Code Section 2.204 requires a 72-hour waiting period after the license is issued before the ceremony can take place. There are three ways to avoid that wait: you are on active military duty, a judge with family law jurisdiction issues a written waiver, or you and your partner complete the Twogether in Texas premarital education program. Twogether is free, takes about eight hours, and gives you a certificate that also reduces the license fee to $21. The certificate must be presented when applying and must be less than one year old.

The license is valid for 90 days from the date of issue. It cannot be extended. If the ceremony does not happen within that window, you must apply again. A duplicate license (in case the original is lost) can also be requested from the clerk.

Only the Nueces County Clerk can issue certified copies of Nueces County marriage licenses. The Texas Department of State Health Services can search its statewide index (1966 to present) and provide a $20 verification letter, but it cannot issue a certified copy. Under Texas Health and Safety Code Section 194.004, that authority belongs exclusively to the county of issuance.

To get a certified copy, contact the Nueces County Clerk at (361) 888-0580 or visit the office at 901 Leopard St. For mail requests, provide both parties' full names, the date of marriage, and payment. Call the office to confirm current fees and accepted payment forms before sending a mail request. Certified copies bear the official seal and are legally valid for name changes, insurance updates, and government filings.

The Nueces County online recorded document search includes marriage licenses. You can search by name to locate a record before requesting a copy. The search tool covers documents filed in recent decades. Contact the clerk for guidance on older records from the 1800s and early 1900s.

Historical Marriage Records in Nueces County

Nueces County was organized on April 18, 1846, carved out of San Patricio County and named for the Nueces River. Marriage records go back to that founding year, with some Spanish and Mexican period documentation surviving from the pre-statehood era. Corpus Christi was already a significant settlement when the county was formed, which helps explain why early records exist at all.

For genealogical research, FamilySearch holds digitized microfilm from many Texas counties including Nueces. The Texas State Library and Archives Commission may also have materials from the early Republic era. The DSHS statewide index is the practical tool for records from 1966 forward. Requests to DSHS can be made online through Texas.gov or by mail using Form VS-142.9.

Informal Marriage in Nueces County

Texas recognizes informal marriage under Texas Family Code Section 2.401. Couples in Nueces County can sign a Declaration of Informal Marriage at the county clerk's office to make their relationship an official public record. The fee is typically $46.

Three elements must all exist: agreement to be married, living together in Texas as spouses, and presenting to others as a married couple. Without the declaration, these elements can still be proven in court, but the process is harder. The declaration creates a clear, searchable public record. Once the declaration is on file, community property law applies, and ending the marriage requires a full divorce proceeding.
