Marriage Licenses in Henderson County

Both applicants must appear together at the Henderson County Clerk's office to apply for a marriage license. Each person needs a government-issued photo ID and their Social Security number. No blood test is needed. Under Texas Family Code Chapter 2, applicants must be at least 18 years old, and the license can be used anywhere in Texas once issued in Henderson County.

The standard fee is $81. Couples who complete the Twogether in Texas premarital education program qualify for a reduced fee of $21. The completion certificate must be presented at the time of application. It also waives the 72-hour waiting period that applies to all other applicants. Without the certificate, Texas law requires a 72-hour wait between the time the license is issued and when the ceremony can legally take place.

The license is valid for 90 days from the issue date. If the ceremony does not occur within that period, the license expires with no option to renew. Check your planned ceremony date before going in to apply.

Note: Texas issues marriage licenses, not marriage certificates. The certified copy of your marriage license is the official legal document you receive as proof of marriage.

Common-Law and Informal Marriage

Texas recognizes informal marriage under Texas Family Code Section 2.401. In Henderson County, couples can register an informal marriage by completing and signing a Declaration of Informal Marriage at the clerk's office. This creates a public record with full legal standing.

Without that declaration, a couple may still be recognized as informally married if they can show that all three conditions are met: they agreed to be married, they lived together in Texas as a married couple, and they represented themselves to others as married. Registering at the clerk's office removes any future dispute about whether the marriage existed. Ask the Henderson County Clerk for the declaration form and any filing requirements.
