Getting a Marriage License in Hartley County

Both applicants must appear in person at the clerk's office. Each needs a valid government-issued photo ID and their Social Security number. No blood test is required. Both parties must be 18 or older. Under Texas Family Code Chapter 2, a license from Hartley County is valid for use anywhere in Texas.

The standard fee is $81. If you complete the Twogether in Texas premarital education course and present the certificate when you apply, the fee drops to $21. The certificate also waives the 72-hour waiting period required by Section 2.204. Without it, you must wait 72 hours after getting the license before the ceremony can happen. The license is good for 90 days; after that it expires and you must start over.

Certified copies of Hartley County marriage records come from the Hartley County Clerk only. The Texas DSHS Vital Statistics office provides verification letters for $20 but does not issue certified copies. Only the county where the license was issued can do that.

To request a copy, visit in person or mail a written request. Include full names of both parties, approximate year of the marriage, and payment. Call the clerk to confirm current fees. Plain copies are available at a lower cost. Certified copies carry the clerk's seal and signature and are accepted for legal purposes. The clerk will search the records and respond once the record is located.

For historical or genealogy research, FamilySearch.org offers free access to some digitized Texas county records. The Texas State Library and Archives Commission also holds early Texas vital records.

What Hartley County Marriage Records Contain

Texas marriage applications collect both parties' full legal names, dates of birth, addresses, and Social Security numbers. The record also includes the license issue date, ceremony date, ceremony location, and the officiant's name. Prior marriages and how they ended are noted as well. Under Texas Health and Safety Code Chapter 194, the county clerk must send a copy to the state within 90 days. The state keeps a statewide alphabetical index. The county keeps the original. Both are public records accessible to anyone.

Informal Marriage Records in Hartley County

Texas recognizes informal marriage under Texas Family Code Section 2.401. Couples can sign a Declaration of Informal Marriage at the Hartley County Clerk's office to create an official record. This document has the same legal standing as a formal marriage license. Without a declaration, you can still prove an informal marriage by showing all three required elements: an agreement to marry, living together as spouses in Texas, and holding out to others as married.

An informal marriage in Texas requires a formal divorce to end, just like a ceremonial marriage. The Hartley County Clerk can provide the form and file the declaration once signed by both parties.
