Marriage License Requirements in Hardeman County

Both applicants must appear in person at the clerk's office. Each needs a valid photo ID and their Social Security number. You do not need a blood test. Both people must be 18 or older to marry in Texas without a court order. Under Texas Family Code Chapter 2, a license from Hardeman County can be used for a ceremony anywhere in Texas.

The standard fee is $81. Couples who complete the Twogether in Texas premarital education course pay only $21 and do not have to wait the 72 hours that Texas law otherwise requires under Section 2.204. The program is free and available throughout the state. The certificate from the course is valid for one year.

Once issued, the license is valid for 90 days. If the ceremony does not happen in that time, the license expires and you must reapply. There is no extension process. Plan your ceremony date before going to the clerk's office so the timing is right.

Certified copies of marriage licenses issued in Hardeman County are only available from the Hardeman County Clerk. The Texas Department of State Health Services maintains a statewide index and issues verification letters for $20, but they cannot issue certified copies. Only the county clerk where the license was filed can do that.

To get a certified copy, go in person to the courthouse or send a written request by mail. Include the full names of both parties, the approximate year of the marriage, and payment for the applicable fee. Call ahead to confirm the current fee and any identification requirements. The clerk will search the records and provide the copy once it is found. Plain copies are available at a lower cost than certified copies.

For genealogy research on older records, FamilySearch.org has some digitized Texas county records. The Texas State Library and Archives Commission also holds historical marriage records from early Texas counties.

What Hardeman County Marriage Records Contain

Marriage license applications in Texas collect both parties' full legal names, dates of birth, addresses, and Social Security numbers. The record shows the date the license was issued, the date of the ceremony, the location, and the name of the officiant. Prior marriages and how they ended are also part of the record. Under Texas Health and Safety Code Chapter 194, the county clerk must file a copy with the state within 90 days of the application.

The state maintains a statewide index under both parties' names. The county keeps the original. Both are public records. Anyone can request a copy with enough identifying information to find the right record. Private financial details are not included in the public record.

Informal Marriage Records

Texas recognizes informal marriages. Under Texas Family Code Section 2.401, a couple can register an informal marriage by signing a Declaration of Informal Marriage at the county clerk's office. This makes the relationship a matter of official public record. It is the clearest way to document a common law marriage and provides strong evidence in legal, financial, and estate matters.

Without the declaration, a couple can still prove an informal marriage existed if they can show they agreed to be married, lived together as spouses in Texas, and held themselves out to others as married. All three elements must be present. To end an informal marriage, a formal divorce is required, just as with a ceremonial marriage.
