Applying for a Marriage License

Both parties must appear together at the clerk's office to apply. You each need a government-issued photo ID and your Social Security number. No blood test is required. Both people must be at least 18 years old. Under Texas Family Code Chapter 2, a license from any Texas county is valid for use anywhere in the state.

The standard fee is $81. If you complete the Twogether in Texas premarital education course and present the certificate when you apply, the fee drops to $21 and the 72-hour waiting period is waived. The certificate is valid for one year from completion. Without it, Texas law under Section 2.204 requires you to wait 72 hours after getting the license before the ceremony can take place.

The license is good for 90 days once issued. If no ceremony happens in that window, you must start over and apply again. Plan your ceremony date before going to the clerk so the timing works out. There is no extension or renewal option.

Certified copies of Hansford County marriage records must come from the Hansford County Clerk. The state office, Texas DSHS Vital Statistics, only issues verification letters, not certified copies. For any official purpose such as a name change, insurance update, or government benefit, you need a certified copy from this office.

Requests can be made in person or by mail. For mail requests, send a letter with the full names of both parties, the year of the marriage, your return address, and payment for the applicable fee. Call the clerk first to confirm the current copy fee. The clerk will mail the certified copy to you once it is located and processed.

Older records may be available in ledger form. Hansford County has marriage records going back to its organization. If you are doing genealogy research, FamilySearch.org may have digitized some older indexes for Texas Panhandle counties at no charge.

What the Records Show

Texas marriage license records follow a state-prescribed format. Each application lists both parties' full legal names, dates of birth, current addresses, and Social Security numbers. It shows the date and county the license was issued, the date and location of the ceremony, and the officiant's name. Prior marriages, if any, and how they ended are also part of the record.

Under Texas Health and Safety Code Chapter 194, the county clerk sends a copy of each completed application to the state within 90 days. The state keeps a statewide alphabetical index under both parties' names. The county holds the original document. Both are public records accessible to anyone who asks for them.

Informal Marriage in Hansford County

Texas allows couples to establish an informal marriage, also known as common law marriage. Under Texas Family Code Section 2.401, a couple can register an informal marriage by signing a Declaration of Informal Marriage at the county clerk's office. The declaration is then filed as an official public record.

Alternatively, a couple can prove an informal marriage existed by showing they agreed to be married, lived together in Texas as spouses, and represented to others that they were married. All three conditions must be met. The Hansford County Clerk can provide a Declaration of Informal Marriage form if you want to register the relationship officially. Once recorded, it has the same legal standing as a formal marriage license.
