Requirements for a Marriage License
Both applicants must appear in person at the county clerk's office. You need a valid government-issued photo ID. A Texas driver's license, passport, certified birth certificate issued within the past 10 years, or military ID all satisfy this requirement. Each person must provide their Social Security number on the application.
Both parties must be 18 or older. Texas law no longer allows minors to marry even with parental consent unless they have a court order for general emancipation. This change took effect in 2017.
Under Texas Family Code Chapter 2, a marriage license obtained in any Texas county is valid statewide. So even though Mesquite residents typically use the Dallas County office, the license works anywhere in Texas. One applicant being absent is allowed under certain conditions, but both parties generally need to be present.
If you divorced within the last 30 days, you cannot remarry until the 30-day period is up. Bring your divorce decree if this applies to you.
Fees and the 72-Hour Waiting Period
Dallas County charges $81 to $82 for a standard marriage license (cash payable). If you apply online, there is an additional $10 processing fee. If you complete the Twogether in Texas premarital education program and present the certificate at the time of application, Dallas County takes $60 off the fee. The program is free to complete and can save you a meaningful amount on the license.
After the clerk issues the license, a 72-hour waiting period begins before you can legally hold the ceremony. This is required under Texas Family Code Section 2.204. The Twogether certificate also waives this waiting period, so you could apply and get married the same day if you have completed the course.
Your license stays valid for 90 days from the issue date under Section 2.201. If you do not get married within that window, the license expires. You would need to apply and pay again. Make sure your ceremony is scheduled before you apply.
Note: Certified copies of marriage records are available from the Dallas County Clerk. The state DSHS office can only provide verification letters, not certified copies.

Texas recognizes informal (common law) marriage. Under Texas Family Code Section 2.401, a common law marriage exists when both parties agree to be married, live together in Texas as spouses, and represent to others that they are married. No time minimum applies. The marriage can exist from day one if all three conditions are present.
Mesquite and other Dallas County residents can sign a Declaration of Informal Marriage at any Dallas County Clerk office to formalize and document the relationship.
