Potter County Clerk in Amarillo

Amarillo is the county seat of Potter County, and the Potter County Clerk is located in the city. The clerk issues marriage licenses, records official documents, and maintains vital records including birth and death certificates. Both applicants must appear at the clerk's office in person at the same time. No mail-in applications are accepted for new marriage licenses. Come prepared with your IDs and Social Security numbers.

One important note for Amarillo residents: the city straddles Potter and Randall counties. If you live in the southern portion of Amarillo, your address may fall under Randall County's jurisdiction rather than Potter County's. If you are not sure which county applies to you, check your county tax records or contact both clerks before making the trip. You can apply for a marriage license from either county and use it anywhere in Texas.

Getting a Marriage License in Amarillo

Both applicants must appear at the Potter County Clerk's office together. Under Texas Family Code Chapter 2, each person must bring valid government-issued photo ID and provide their Social Security number. Acceptable IDs include a driver's license, passport, certified birth certificate issued within the past 10 years, or military ID. The clerk verifies your IDs, takes payment, and issues the license on the spot.

Contact the Potter County Clerk to confirm the current license fee before your visit. Standard Texas fees are around $81.00. Completing the free Twogether in Texas premarital education course and bringing the certificate to your appointment reduces the fee by $60. The certificate must be presented at the time of application. Completing Twogether also waives the 72-hour waiting period that Texas otherwise requires before any ceremony can take place.

The 72-hour wait is required by Texas Family Code Section 2.204. The wait starts the moment the clerk issues the license. Active-duty military members deploying to hostile fire zones can get the wait waived with valid military ID. The license is valid for 90 days from the issue date under Section 2.201. If you do not use it within that time, you must reapply. After the ceremony, the officiant must sign the license and return it to the Potter County Clerk within 30 days. That return is what creates the official Amarillo marriage record.

For residents in the Randall County portion of Amarillo, the Randall County Clerk handles licenses for that area. The process and state law requirements are the same, but the office and fees may differ slightly. Contact both offices if you are unsure which one applies to your address.

Potter County marriage records are maintained by the County Clerk in Amarillo. For in-person searches, visit the clerk's office with the names of both parties and any dates you have. Staff can search the records and tell you what is available. The clerk's website has contact information and may have online tools for searching recorded documents. Check both the main county site at co.potter.tx.us and the My Potter County portal before visiting.

The Texas Department of State Health Services maintains a statewide marriage index from 1966 to present. DSHS can issue a verification letter for $20 but cannot provide certified copies. Certified copies must come from the Potter County Clerk or, for Randall County portion residents, the Randall County Clerk. For genealogical research on older records, FamilySearch and the Library of Congress Texas local history resources are good starting points after you exhaust the county clerk's holdings.

Note: If a marriage occurred in the Randall County portion of Amarillo, the record is held by the Randall County Clerk, not the Potter County Clerk.

Certified Copies of Amarillo Marriage Licenses

Certified copies of Potter County marriage licenses are available only from the Potter County Clerk. The state office at DSHS cannot certify individual licenses under Texas Health and Safety Code Chapter 194. You need a certified copy for name changes, government ID updates, insurance claims, and legal filings. The county clerk is the only source for this document.

Visit the clerk's office in person to request a certified copy. Bring a valid photo ID and know the names of both parties and the approximate marriage date. In-person requests are usually handled the same day. Mail requests are also accepted at most Texas county clerk offices. Include a written request with full names, marriage date, a copy of your ID, and payment for the applicable fee. Contact the Potter County Clerk before sending to get the current fee and correct mailing address.

In-person is faster. Mail requests can take weeks depending on current volume. If the copy is needed for a time-sensitive purpose, go in person.

Informal Marriage in Potter County

Texas law recognizes informal marriage under Texas Family Code Section 2.401. Three things must all be true at the same time: both parties agreed to be married, both lived together as a couple in Texas, and both represented to others that they are married. No ceremony is needed. All three elements must exist simultaneously for the marriage to be legally valid.

Amarillo couples in the Potter County portion of the city can register an informal marriage by filing a Declaration of Informal Marriage at the Potter County Clerk's office. This creates a formal written record. Once filed, the marriage has the same legal effect as a ceremonial one, including community property rights. Ending it requires a formal divorce. Couples in the Randall County portion of Amarillo would file with the Randall County Clerk instead. If you have questions about which county applies to your address, or about the legal implications of informal marriage, consult a family law attorney before filing.

The City of Amarillo official portal provides city services and general information for residents, but marriage licenses and vital records for Amarillo residents are handled by the Potter County Clerk, not the city.
